Exclusive: Of diapers and drugs, Iran's trouble paying bills

WASHINGTON (Reuters) - Like everyone, Iranians need diapers. Fred Harrington has built a business by selling Iran the raw materials to make them.

The Redmond, Washington, businessman, who exports to Iran under a humanitarian license from the U.S. Treasury Department, says he is owed close to $3.8 million by Iranian companies who cannot pay him because of the latest U.S. and European Union sanctions.

He is not alone.

U.S. firms from major drug makers like Merck & Co. to mom-and-pop outfits like Harrington's American Pulp & Paper Corp. are finding it hard to get paid even for medicines and other humanitarian exports explicitly allowed by the U.S. Treasury, according to officials, sanctions lawyers and the companies.

"Everything from aspirin to multivitamins - you name it - it's all jammed up," said Cari Stinebower, an international trade lawyer with Crowell & Moring, a Washington, D.C.-based law firm, and a former counsel for the Treasury Department's Office of Foreign Assets Control (OFAC).

The payments gridlock is a testament to the effectiveness of the latest round of financial sanctions, which aim to force Iran to curb its nuclear program and which have made the Iranian banking sector even more radioactive for major global banks.

But they also undercut the long-standing U.S. argument that its sanctions are not meant to squeeze the Iranian people but rather the Islamic republic's leaders and their suspected pursuit of nuclear weapons.

"I am not against punishing Iran for being a rogue country but the United States, or the Europeans, when they start imposing sanctions, then they must consider, also their own companies," Harrington said.

Harrington, an Iranian American who changed his name from Farhad Fouroohi, had to lay off three people in February because of the payments delays, cutting his staff from seven to four.

OUTSIZE IMPACT

While a new U.S. law targeting financial institutions that deal with the central bank of Iran has garnered much attention, sanctions lawyers said the January 23 blacklisting of one Iranian bank had a more immediate, sharp effect on humanitarian trade.

Bank Tejarat, Iran's third-largest bank, was "designated" - or blacklisted - under a U.S. executive order targeting people and companies that promote the proliferation of weapons of mass destruction as well as their support networks.

The action has the effect of cutting them off from the U.S. financial system, along with any bank who deals with them - a risk that many banks find impossible to take.

Over the last five years, the Treasury has blacklisted 23 such Iranian-linked entities, gradually squeezing Iran's ability to do business with the world.

Tejarat's blacklisting has had an outsize impact, sanctions lawyers said, because it had been the last major Iranian bank available for legal trade with Iran. With it now off limits, companies are having to sift through smaller banks to find some that can carry out the transactions - which is no mean feat.

"That has had a huge ripple effect," said Douglas Jacobson, a Washington attorney who focuses on sanctions work.

"On the one hand, you can get a license. The government is saying, 'OK you can sell.' But the practical reality is that you can't get paid," he added.

The lawyer said one of his clients is out several hundred thousand dollars because of the Tejarat blacklisting and that he knows of several medical companies that have stopped exporting to Iran because of the payment problems.

"Where you had a small window of opportunity previously, that window is now almost completely closed," said Erich Ferrari, another lawyer who specializes in trade sanctions.

The decision on Thursday by Belgium-based SWIFT, the world's biggest electronic payment system, to expel all Iranian banks blacklisted by the European Union, may make it even harder to conduct transactions, sanctions lawyers said.

The United States has gradually tightened sanctions because of Iran's failure to answer questions about its nuclear program, which Washington and its allies suspect is a cover to develop nuclear weapons. Iran says it is solely to generate power.

The sanctions became much tougher when U.S. President Barack Obama on December 31 signed a law designed to choke off Iran's oil sales by threatening to cut off foreign banks from the U.S. financial system if they dealt with Iran's central bank.

Merck & Co., the world's third-largest pharmaceuticals company, said it has licenses to sell Iran products to treat diabetes, cancer, respiratory illnesses and infections.

"(Merck) has experienced a challenging situation in 2012 in terms of securing payments for goods shipped," said Merck spokeswoman Kelley Dougherty, adding the company was open to ideas to "facilitate exports of humanitarian goods, including medicines," in accordance with U.S. law and regulations.

Pfizer Inc, the world's largest pharmaceuticals maker whose flagship products include the cholesterol-lowering drug Lipitor, acknowledged challenges in getting paid for Iranian sales, saying it would work through them. Both Merck and Pfizer declined to provide details.

"There is some turbulence right now," said Pfizer spokesman Peter O'Toole, saying the company wished to ensure that Iranian patients have access to needed medications. "If we have to work through a little turbulence, that's what we'll do."

A Treasury Department official who spoke on condition of anonymity said its approach on humanitarian exports to Iran had not changed, though he did not directly address questions about the difficulty that U.S. companies were having getting paid.

"There's been no decrease in applications to OFAC to export humanitarian items to Iran," the spokesman added. "The recent sanctions imposed on Iran have not changed our approach to the export of food, medicine and medical devices to Iran."

For companies such as Pfizer or Merck, exports to Iran are a tiny fraction of their worldwide business.

If ordinary Iranians ultimately suffer shortages of drugs and medical devices, the Iranian government may use it to score public relations points with their own people against the West, much as former Iraqi dictator Saddam Hussein did in Iraq.

"They need to defend their position to their own population. They need to continue to create this image of an international community that is implacably aligned against the interests of a defenseless Iran," said Suzanne Maloney, a senior fellow at the Brookings Institution's Saban Center for Middle East Policy.

"This kind of imagery would play into that and it'll have a certain resonance among Iranians who have a long experience with sanctions, resent the impact of sanctions on ordinary citizens and believe ... the government is well able to insulate itself."

'WASHINGTON'S EARS ARE CLOGGED'

The United States bars virtually all trade with Iran. It cut diplomatic ties with Iran in 1980 after Iranian students seized its embassy in Tehran and ultimately held 52 Americans hostage for 444 days.

Last year, the United States exported only $229.5 million worth of goods to Iran.

"Woodpulp and pulpwood" - which includes the raw material for diapers - accounted for $57.9 million, followed by $50.1 million for pharmaceuticals, $29.5 million for plastics, $23.4 million for unmanufactured farm products and $22 million for medical devices, according to U.S. Commerce Department data. Under a quirk in U.S. law, the export of diapers to Iran is not allowed but the export of fluff pulp, their key component, is, creating an opportunity for Harrington to sell it to Iran.

Of the $26.6 million in sales his company had last year, Iran accounted for roughly 70 percent.

The impact has been so big that Harrington wrote U.S. President Barack Obama a plaintive letter on February 9, saying the latest U.S. sanctions "have virtually stopped our business overnight."

"We would appreciate your comments and any suggestions as to what we could possibly do at this point," Harrington wrote. "From our perspective, it would seem that there is nothing left to be done except to close our doors."

Harrington, who argues there should have been a "wind-down" period to clear existing payments, has received no reply.

"We have not received any reaction and I don't expect to," he said. "Washington's ears are clogged. They don't hear it at all."

One such set of developers have crafted together a version of Ice Cream Sandwich that runs on an Asus netbook, demonstrated here on an Asus EeePC X101Ch.

This isn't endorsed in anyway by Asus, but the fellows on the Android x-86 project have compiled a  reasonably functional build of ICS for use on the netbook. They're still working on multi-touch support, support for external monitors, Ethernet support and support for all applications. ALLEN PARK, Mich. (AP) ? For five years, Calvin Johnson has thrilled Detroit Lions fans, helping the city's troubled NFL franchise recover from almost unimaginable depths to become one of the league's most exciting young teams.

Now the Lions are rewarding the star receiver, giving "Megatron" a contract worthy of his catchy nickname.

Johnson has signed an eight-year deal worth up to $132 million, the largest contract in NFL history. He had a year remaining on a deal he signed after being drafted in 2007, but this extension starts immediately and runs through the 2019 season.

"I'm so comfortable here now," the 26-year-old Johnson said at news conference Wednesday. "At first, not at all, but being here for five years, being around these people here in Detroit, teammates and just the city ? I'm just growing accustomed to it."

Johnson's agent, Bus Cook, said the contract is worth $60 million guaranteed. That figure and the total value of the deal are both NFL records.

"Calvin's one of those guys ? we've said this about a few guys that we have in our building ? whatever they pay him is not enough," Lions coach Jim Schwartz said. "He's truly a special player."

After years of questionable drafts, the Lions finally began building a talented nucleus when they took Johnson with the No. 2 overall pick in 2007. Detroit went 0-16 in his second season but added quarterback Matthew Stafford with the top pick in 2009. The Lions then took defensive tackle Ndamukong Suh with the second pick the following year.

Detroit made the playoffs last season for the first time in a dozen years. The challenge now is keeping these stars long term, and the Lions took care of Johnson with minimal angst.

"They were happy to get this thing done with, and I was happy as well," Johnson said. "It wasn't a lot of confrontation. We weren't butting heads or anything. It was just something that we knew needed to get done."

The 6-foot-5 Johnson is a two-time Pro Bowler and his 45 touchdowns receiving are the most in the NFL since 2008. His deal tops one given to receiver Larry Fitzgerald of Arizona last year ? an eight-year deal that could pay him as much as $120 million.

News of the record contract rippled across the league.

Vikings running back Adrian Peterson, who signed a 7-year deal worth up to $100 million at the start of last season, tweeted: "Calvin Johnson! Brother you're Worth every cent!!! But hey,Can I borrow a Dollar! Hahaha Now that's how its done! Congratulation!"

Johnson is coming off a spectacular season in which he caught 96 passes for a league-best 1,681 yards and 16 touchdowns. He became the third player in NFL history with at least 95 receptions, 1,600 yards and 15 touchdowns in a season, joining Jerry Rice and Randy Moss.

He's also one of six receivers to post at least 45 TD catches and 5,000 yards receiving in a four-season span, along with Rice, Moss, Terrell Owens, Marvin Harrison and Lance Alworth.

"There are not many guys when you do a contract of this magnitude," team president Tom Lewand said. "We obviously did one years ago with Barry Sanders, and he was one of those kinds of guys, who is so special on the field, truly deserving of a contract of this size, and a guy who you have no doubt will handle all that comes with it with a great deal of skill on and off the field."

Stafford is coming off his first full season of good health. Johnson and the rest of the team benefited.

"We know what Matt can do," Johnson said. "We know what we can do as an offense. We can get hot at any time. There's a lot of potential."

In the playoffs, Johnson caught 12 passes for 211 yards and 2 touchdowns in a loss to New Orleans, becoming the first player with 200 yards receiving in a playoff debut.

Johnson said the conclusion of Peyton Manning's tenure in Indianapolis made him appreciate the opportunity to stay with the Lions for a while.

"The comfort level you receive, being able to be in one place for a long time, is unlike any other," Johnson said. "Having security, not having to worry about where I'm going to be next year. And then two ? having a good team, having a lot of guys locked up on this team that you've had success with, and that you just continue to grow with."

Stafford has three years left on the deal he signed as a rookie, so the Lions appear set with arguably the league's top quarterback-receiver tandem for the foreseeable future.

"When you're fortunate to have a good quarterback, those don't come by a lot in the league," Johnson said. "How many teams are looking for a No. 1 quarterback right now? I would have to be beside myself to leave here."

The feeding habits of teenage galaxies

Astronomers have known for some time that the earliest galaxies were much smaller than the impressive spiral and elliptical galaxies that now fill the Universe. Over the lifetime of the cosmos galaxies have put on a great deal of weight but their food, and eating habits, are still mysterious. A new survey of carefully selected galaxies has focussed on their teenage years ? roughly the period from about 3 to 5 billion years after the Big Bang.

By employing the state-of-the-art instruments on ESO's Very Large Telescope an international team is unravelling what really happened. In more than one hundred hours of observations the team has collected the biggest ever set of detailed observations of gas-rich galaxies at this early stage of their development.

"Two different ways of growing galaxies are competing: violent merging events when larger galaxies eat smaller ones, or a smoother and continuous flow of gas onto galaxies. Both can lead to lots of new stars being created," explains Thierry Contini (IRAP, Toulouse, France), who leads the work.

The new results point toward a big change in the cosmic evolution of galaxies, when the Universe was between 3 and 5 billion years old. Smooth gas flow (eso1040) seems to have been a big factor in the building of galaxies in the very young Universe, whereas mergers became more important later.

"To understand how galaxies grew and evolved we need to look at them in the greatest possible detail. The SINFONI instrument on ESO's VLT is one of the most powerful tools in the world to dissect young and distant galaxies. It plays the same role that a microscope does for a biologist," adds Thierry Contini.

Distant galaxies like the ones in the survey are just tiny faint blobs in the sky, but the high image quality from the VLT used with the SINFONI instrument means that the astronomers can make maps of how different parts of the galaxies are moving and what they are made of. There were some surprises.

"For me, the biggest surprise was the discovery of many galaxies with no rotation of their gas. Such galaxies are not observed in the nearby Universe. None of the current theories predict these objects," says Benoit Epinat, another member of the team.

"We also didn't expect that so many of the young galaxies in the survey would have heavier elements concentrated in their outer parts ? this is the exact opposite of what we see in galaxies today," adds Thierry Contini.

The team are only just starting to explore their rich set of observations. They plan to also observe the galaxies with future instruments on the VLT as well as using ALMA to study the cold gas in these galaxies. Looking further into the future the European Extremely Large Telescope will be ideally equipped to extend this type of study deeper into the early Universe.
